Terms of Service – SmartCaliper.App

1. General provisions

These Terms govern the use of the Smart Caliper App online. Administrator: CodeAndDesign.pl, Email: admin@codeanddesign.pl.

Full version requires an account via Google OAuth. Account allows paid subscription or demo version (limited to 2 programs).

5. Right of withdrawal

Consumers:

Consumers have the right to withdraw from a subscription purchase within 14 days without giving a reason, subject to applicable law. The right of withdrawal shall be lost if the consumer expressly consents to the immediate commencement of the Service and acknowledges that they will lose their right of withdrawal once the Service has begun.

Companies (B2B):

Companies that are legal entities have the right of withdrawal. *Note: The right of withdrawal may apply to natural persons conducting business (sole proprietors) if the contract is concluded primarily for purposes unrelated to their professional activity, in accordance with EU law.*

6. Complaints and refunds

Complaints should be sent to: admin@codeanddesign.pl. They are handled promptly and according to applicable EU law.

7. Liability

The controller is not responsible for user errors or technical problems related to the user's internet access or the external payment service (Stripe). The controller's liability for damages is excluded to the fullest extent permitted by law, except for damages resulting from willful misconduct or gross negligence.

8. Account termination

Users may delete their account at any time, terminating the service. Contact admin@codeanddesign.pl if You wish to delete acount.

9. Final provisions

These Terms are governed by Polish law. Any disputes between the Administator and a non-consumer User shall be resolved by the court having jurisdiction over the controller's seat. For consumer Users, the mandatory rules on jurisdiction under Polish and EU law shall apply.
